By accessing or using Calisthenics Hub (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

• "Service" refers to the Calisthenics Hub website, mobile applications, and all related services, features, and content.
• "User," "you," "your" refers to any individual who accesses or uses the Service, whether registered or not.
• "We," "us," "our" refers to Calisthenics Hub and its operators.
• "Content" refers to all text, images, photos, videos, audio, data, and other materials uploaded, posted, or transmitted through the Service.
• "User Content" refers to Content that users submit, post, or transmit to the Service, including reviews, photos, and spot submissions.
• "Spot" refers to a calisthenics park, outdoor gym, or workout location listed on our map.

To use the Service, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Not have been previously suspended or removed from the Service

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Some features of the Service require account registration. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or contain false or misleading information.

Calisthenics Hub provides:

• An interactive map of calisthenics parks and outdoor workout locations
• User-submitted reviews, photos, and ratings of workout spots
• Community forums and discussion features
• Exercise guides and training resources
• User profiles and community features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

6.1 Ownership

You retain ownership of the User Content you submit. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.

6.2 Responsibility

You are solely responsible for your User Content and represent that:

• You own or have the necessary rights to post the content
• The content does not infringe any third-party rights
• The content is accurate and not misleading
• The content complies with these Terms and applicable laws

6.3 Moderation

We do not pre-screen User Content but reserve the right to remove, edit, or refuse any content at our sole discretion, without notice, for any reason, including content that violates these Terms or that we find objectionable.

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post false, misleading, or inaccurate information about spots or locations
• Harass, abuse, threaten, or intimidate other users
• Post content that is hateful, discriminatory, defamatory, or obscene
• Impersonate any person or entity or misrepresent your affiliation
• Upload malware, viruses, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Scrape, crawl, or use automated means to access the Service without permission
• Interfere with or disrupt the Service or servers
• Circumvent any security features or access controls
• Use the Service to send spam or unsolicited communications
• Collect or harvest user information without consent
• Post content that infringes intellectual property rights
• Engage in any activity that could damage our reputation

The Service and its original content (excluding User Content), features, and functionality are owned by Calisthenics Hub and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used without our prior written consent.

Map data is provided by OpenStreetMap contributors and is available under the Open Database License (ODbL). You must comply with the ODbL when using map data from our Service.

The Service may contain links to third-party websites or services that are not owned or controlled by Calisthenics Hub. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

We use third-party services including but not limited to:

• OpenStreetMap for map data
• CARTO for map tiles
• Nominatim for geocoding
• Google for authentication (optional)

Your use of third-party services is subject to their respective terms and privacy policies.

We specifically disclaim:

• Any warranty that the Service will be uninterrupted, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of spot information
• Any warranty that defects will be corrected
• Any warranty regarding the safety or condition of workout spots

Physical Activity Disclaimer

Calisthenics and street workout activities involve inherent risks of injury. The information on our Service is for general informational purposes only and is not professional fitness advice.

• Always consult a physician before starting any exercise program
• Inspect equipment before use and exercise at your own risk
• We are not responsible for injuries sustained at any listed location
• Spot conditions may change; verify current conditions before visiting

In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or one hundred euros (EUR 100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Calisthenics Hub and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, to the extent required by local consumer protection laws. For matters not covered by mandatory local law, these Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through the following process:

1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
2. Mediation: If unresolved within 30 days, either party may request mediation
3. Arbitration or Litigation: If mediation fails, disputes may be resolved through binding arbitration or court proceedings in your jurisdiction

14.3 Regional Provisions

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Updating the "Last Updated" date at the top of this page
• Posting a notice on our website
• Sending an email to registered users (for material changes)

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.
